SMS Terms

Everything you need to know about text messages from KG Homes — how you opt in, how you opt out, and how we handle your phone number.

This page describes how KG Homes uses SMS (text) messaging to communicate with property sellers and prospective sellers. It is a companion to our Privacy Policy and Terms of Service.

1. Program description

KG Homes operates a high-volume Mixed A2P 10DLC SMS messaging program — meaning a single program that sends both transactional / informational messages and promotional / marketing messages — to property sellers and prospective sellers across the United States. The program is registered with The Campaign Registry (TCR) as a Mixed use case, complies with applicable provisions of the Telephone Consumer Protection Act (TCPA) and CTIA Short Code Monitoring Handbook guidelines, and uses long-code (10DLC) numbers approved by U.S. wireless carriers.

The program has two independent opt-in categories:

Each category has its own consent. Opting in to one does not opt you in to the other. Opting in to promotional messages is never required to receive a cash offer or to work with KG Homes in any capacity.

2. How to opt in

You opt in only by actively checking the relevant consent box on the cash-offer form at kg-homes.pages.dev. Both consent boxes are unchecked by default. The exact language of each consent box reads:

Transactional consent: "I agree to receive non-promotional SMS messages from KG Homes about my property inquiry — cash-offer confirmations, document signing reminders, and closing-coordination updates. Message frequency varies, up to 6 messages per month. Msg & data rates may apply. Reply STOP to opt out, HELP for help."

Promotional consent: "I separately agree to receive promotional SMS messages from KG Homes about new buying programs, market updates, and seller resources. This is optional and not required to receive an offer. Up to 6 msgs/month. Msg & data rates may apply. Reply STOP to opt out, HELP for help."

Once you submit the form with a consent box checked, you will receive a confirmation SMS shortly afterward. The confirmation message identifies KG Homes and re-states how to opt out and how to get help.

3. How to opt out

You may opt out of either or both SMS categories at any time. To opt out:

After we receive your STOP reply, we will send a single final confirmation message and then stop further messages in that category. Opt-out is processed within 24 hours.

4. How to get help

Reply HELP to any text message and we will respond with contact information for assistance, or contact us directly at (702) 439-6909 Monday through Friday, 9:00 AM – 5:00 PM Pacific.

5. Message frequency

Message frequency varies based on where you are in our process. Transactional messages are sent only as needed to coordinate your specific inquiry or transaction. Promotional messages are sent occasionally. We cap outbound SMS at up to 6 messages per month per category. If you opt in to both, the combined total may reach 12 messages per month, but this is uncommon.

Although KG Homes is provisioned with carriers as a high-volume sender (up to 600,000 message segments per day across our entire seller base), any individual recipient remains capped at the per-recipient frequencies disclosed above. High-volume provisioning exists to handle scale across many opted-in recipients — not to send any single recipient more messages.

6. Message and data rates

Standard message and data rates from your wireless carrier may apply. KG Homes does not charge for SMS messages; any charges come from your carrier under your wireless plan.

7. Supported carriers

The KG Homes SMS program works with all major U.S. wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, US Cellular, and their MVNOs. Carriers are not liable for delayed or undelivered messages. Delivery success depends on carrier conditions outside our control, including signal availability and carrier filtering.

7.1 Age requirement

You must be at least 18 years of age to enroll in the KG Homes SMS program. By opting in, you confirm that you are 18 or older and that the phone number you provided belongs to you.

7.2 Compliance

KG Homes operates this SMS program in good-faith compliance with the Telephone Consumer Protection Act (TCPA), applicable state telemarketing statutes, and the CTIA Short Code Monitoring Handbook / Messaging Principles & Best Practices. We maintain timestamped, IP-stamped records of every opt-in submission so that consent can be verified on request.

8. Privacy of mobile information

KG Homes does not share, sell, rent, or otherwise disclose your phone number or your SMS opt-in information to any third party for marketing or promotional purposes. No mobile information collected for the purpose of obtaining SMS consent is shared with third parties or affiliates for marketing or promotional purposes. This restriction applies to all opt-in data regardless of category.

We do disclose phone numbers to the service providers that operate our messaging platform (our CRM and SMS delivery vendor) strictly for the purpose of delivering the messages you have agreed to receive. These providers are bound by contracts that limit their use of your data to the services they provide to KG Homes.

9. Changes to this SMS program

We may revise this SMS Terms page from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes that affect your existing consent will be communicated by SMS before they take effect.
